Whether Punitive Damages May Be Available
Punitive damages are rarely awarded in New Jersey personal injury cases, because state law strictly limits when they are allowed. To receive an award for them, your injury lawyer will need to provide clear and convincing evidence that the defendant’s actions displayed a wanton and willful disregard for your wellbeing, or were based on malice. You cannot win punitive damages in New Jersey by proving negligence, or even gross negligence.

Will my personal injury case go to trial?
Chances are good that your injury case will not go to trial. Approximately 90% of injury cases in the United States are settled outside of court. Just in case negotiations are unsuccessful, however, our law firm will prepare your case as if it’s headed for trial from the beginning.
Should I talk to the insurance company about my case?
We recommend that you speak with an experienced attorney before you divulge any unnecessary information to the insurance company. Most insurance adjusters are experts at twisting victims’ statements around to avoid paying out on injury claims. Without advice from your lawyer, you could say or do something that could jeopardize your right to recover compensation from the party who harmed you.
Do I really need to hire a personal injury lawyer?
You have the right to pursue compensation for your injuries without hiring a personal injury attorney, but your chances of success are not great. An experienced lawyer will guide you through the legal system, make sure evidence is preserved, and ensure your rights are protected.
Is New Jersey a No-Fault State for Car Accidents?
New Jersey is one of only 12 states in the nation that are considered “no-fault” states when it comes to car accidents. Our state is unique from many other places, however, because we follow “choice” no-fault law. With traditional no-fault laws, all injured drivers and their passengers file injury claims against their own insurance companies, regardless of who is at-fault or whether negligence is a factor.
All New Jersey drivers are required to purchase a “basic” auto insurance policy that includes minimal levels of personal injury protection (PIP), property damage liability coverage, and uninsured motorist coverage. Since New Jersey is a “choice” no-fault state, however, drivers can purchase “standard” policies that include bodily injury liability coverages. When they purchase these policies, drivers will also choose between “limited right to sue” and “unlimited right to sue” coverages.
People who choose limited right to sue coverage will pay lower premiums, but they can only sue an at-fault driver outside the state’s no-fault law if their injuries are significant or a loved one dies. Unlimited right to sue coverage costs more in premiums, but injured victims are not held to the state’s threshold. Pain and suffering damages, which aren’t always available with limited right to sue coverage, might also be recoverable. For this type of claim to be successful, the plaintiff must prove fault for the accident.
